A recent news article posted by Texas Record highlights the class action lawsuit brought against Ensite USA by day rate employees represented by our firm alongside with Bruckner Burch PLLC. This project management company based out of Houston, Texas allegedly did not pay its day rate workers the appropriate wages. The lawsuit seeks to recover unpaid overtime, liquidated damages and attorneys’ fees and costs.
Ensite required its non-exempt day rate employees to work well over 40 hours per week without paying them the overtime premiums for the hours worked over forty. Instead, the company paid its non-exempt day rate employees a set daily rate, regardless of all their hours worked. Plaintiffs in this matter regularly worked at least 12-hour days and in excess of 40 hours per week with no overtime pay. The lawsuit alleges Ensite violated the Fair Labor Standards Act (FLSA), Kentucky Wage and Hour Laws (“KWHL”) and the Ohio Minimum Fair Wage Act (“OWA”). The Plaintiff in this matter brings this action on behalf of himself and other similarly situated current and former non-exempt day rate employees nationwide. Those day rate employees who choose to opt-in to this class action would be eligible to recover potential wage-and-hour violations under the FLSA, KWHL and OWA.
