Summary:
On Monday, May 18, 2020, Fitapelli & Schaffer, LLP filed a class action lawsuit against Homyn Enterprises Corp.(“Homyn”), also known as Secure Wrap., for unpaid wages. Homyn, who provides baggage protection services to airport customers internationally, has allegedly failed to pay its hourly employees on a timely basis.This lawsuit seeks to recover untimely wage compensation and other damages for hourly customer associates and machine operators as well as other similar manual labor positions (collectively, “Manual Workers”) who work or have worked as manual workers for Homyn in New York State.
Homyn compensated its Manual Workers on a bi-weekly basis despite being manual workers who are entitled to receive their wages every week in accordance with the New York Labor Law (“NYLL”). The complaint alleges that Homyn didn’t consider its hourly customer associates and machine operators as well as other similar manual labor positions as Manual Workers despite the fact that they spent more than twenty-five percent of their time completing physical tasks. These duties included but were not limited to: lifting luggage onto Defendant’s Secure Wrap machine; operating Defendant’s Secure Wrap machine; wrapping luggage in plastic; cutting plastic wrap; lowering luggage and handing it to customers; and keeping the Secure Wrap machine area clean. Homyn’s Manual Workers claim that due to the magnitude of the physical labor involved in their daily tasks, they should have been paid their wages within seven calendar days after the end of the week in which these wages were earned. Additionally, Homyn failed to supply its Manual Workers with an accurate statement of wages with every payment of wages as required by the NYLL. Due to Defendant’s violations of the NYLL, Plaintiff and the New York Class are entitled to recover from Defendant the amount of their untimely paid wages as liquidated damages, statutory penalties of two hundred fifty dollars for each workday that Defendants failed to provide them with accurate wage statements, or a total of five thousand dollars each, reasonable attorneys’ fees and costs, and pre-judgment and post-judgment interest as provided for by NYLL.
