Summary:
On January 27, 2020, Fitapelli & Schaffer, LLP, alongside with Bruckner Burch PLLC, filed a collective and class action lawsuit against Natural Energy Field Services, LLC (“Natural Energy”) for unpaid wages. Natural Energy is a provider of third-party field support services including construction inspection and quality personnel, land and right-of-way acquisition, and survey to the energy industry. They actively operate in oilfields in Pennsylvania, Texas, Virginia, and West Virginia, employing hundreds of non-exempt day rate workers throughout the United States. The lawsuit seeks to represent current and former employees of Natural Energy who were paid a day rate, without overtime pay, such as inspectors.
Day rate employees working for Natural Energy typically work at least 12-hour shifts, seven days a week, for weeks at a time. Even though Natural Energy requires day rate employees to work well over forty hours per workweek, they do not pay them the overtime pay for their hours worked over the forty. Instead, Natural Energy pays at a set daily rate without overtime pay. This violates the Fair Labor Standards Act (FLSA). The Plaintiff in this matter brings this action on behalf of himself and similarly situated current and former day rate employees nationwide who elect to opt-in to this action pursuant to the FLSA to remedy violations of the wage-and-hour provisions of the FLSA by Natural Energy that have deprived these day rate employees of overtime pay.
