Homyn Enterprises Corp., also known as Secure Wrap., has just been sued by its employees for unpaid wages. The business, which is known for providing full service baggage protection assistance internationally to its airport customers, has been accused of failing to pay its hourly employees on a timely basis. This class action lawsuit aims to represent hourly customer associates, machine operators and other similar manual labor positions trying to recover untimely wage pay as well as other damages who work or have worked as manual workers for the company in the state of New York.
Homyn has regularly paid its manual workers every two weeks despite the New York Labor Law (“NYLL”) requiring manual workers be paid on a weekly basis. The lawsuit claims that the company failed to consider its hourly employees in manual labor positions as manual workers despite requiring them to spend more than twenty-five percent of their shifts completing physical tasks. Their manual workers claim that due to the amount of physical labor involved in their daily tasks, they should have been paid their wages within seven calendar days after they ended their work week. The company also failed to provide accurate wage statements to its manual workers as required by the NYLL. Due to these violations these manual workers are entitled to recover the amount of their untimely paid wages as liquidated damages, statutory penalties of two hundred fifty dollars for each workday that Defendants failed to provide them with accurate wage statements, or a total of five thousand dollars each, reasonable attorneys’ fees and costs, and pre-judgment and post-judgment interest as provided for by NYLL.
Unfortunately, many labor intensive industries in New York, do not always pay its workers on a weekly basis.
